Surrogacy is defined as being a process where a female carries a child for an individual or a couple (otherwise known as intended parent or IP) that will become the child's parent. 

Gestational Surrogacy- there is no genetic connection, an egg donor is used

Traditional Surrogacy- there is genetic connection as the surrogates eggs are used

Yes, surrogacy is considered legal in Canada. The Assisted Human Reproduction Act prohibits a person from paying a female person to be a surrogate mother. Although it is illegal to pay a surrogate for her services, it is legal to reimburse for reasonable out of pocket expenses related to pregnancy.

Willing to undergo medical evaluation and psychological assessments

Surrogates in Canada are not paid for carrying a baby, but they are legally entitled to reimbursement for approved reasonable expenses.

 As per the Assisted Human Reproduction Act, the following expenditures incurred by a surrogate mother in relation to her surrogacy may be reimbursed under subsection 12(1) of the Act:

1. travel expenditures, including expenditures for transportation, parking, meals and accommodation;
2. expenditures for the care of dependants or pets;
3. expenditures for counselling services;
4. expenditures for legal services and disbursements;
5. expenditures for obtaining any drug or device as defined in section 2 of the Food and Drugs Act;
6. expenditures for obtaining products or services that are provided or recommended in writing by a person authorized under the laws of a province to assess, monitor and provide health care to a woman during her pregnancy, delivery or the post-partum period;
7. expenditures for obtaining a written recommendation referred to in paragraph (f);
8. expenditures for the services of a midwife or doula;
9. expenditures for groceries, excluding non-food items;
10. expenditures for maternity clothes;
11. expenditures for telecommunications;
12. expenditures for prenatal exercise classes;
13. expenditures related to the delivery;
14. expenditures for health, disability, travel, or life insurance coverage; and
15. expenditures for obtaining or confirming medical or other records.

The Act is meant to provide guidance around activities prohibited and not prohibited under the Canadian law which helps to protect and promote health, safety and dignity to Canadians experiencing infertility and requiring assisted human reproduction to build their families. 

The screening and matching process can take 2–6+ months.  From initial intake to birth, the process typically takes 12–18 months, depending on screening, matching, IVF cycles, and pregnancy. 

Since matching services are not permitted in Canada, we do not directly match intended parents with surrogates. Instead, we provide guidance through psychosocial assessments and share information that highlights values, readiness, and compatibility. This allows intended parents and surrogates to connect in a way that is mutual, collaborative, and built on trust.

That’s up to you both. Some relationships are lifelong, others remain professional. We help you navigate these preferences during the assessment and legal process.

No, our agency does not handle reimbursements directly. We provide guidance and connect you with trusted professionals, such as fertility lawyers, to ensure everything is managed clearly and fairly. 

Yes. While we don’t manage finances, we do assist with navigating the practical side of surrogacy including scheduling, coordinating with clinics, and helping with travel planning if needed. Our role is to take away stress so you can focus on the joy of building your family. 

While we don’t provide legal services directly, we will refer you to an experienced fertility lawyer in Ontario to ensure both surrogates and intended parents receive proper legal advice and support throughout the process.

While we do not facilitate direct matching, we provide thorough psychosocial assessments for surrogates and use these insights to help guide intended parents in reviewing profiles. This process highlights compatibility in areas such as personality, communication style, lifestyle preferences, and expectations for the journey. With both professional expertise in social work and personal experience in surrogacy, we aim to support connections that feel natural, trusting, and well-aligned 

All surrogates complete a thorough screening process that includes medical assessments, psychological evaluations, and lifestyle reviews. At All Ways Family Consulting we also complete our own independent psychosocial assessments. We ensure each surrogate has access to independent legal advice, so they enter the process with clarity and confidence. This helps create a strong foundation for the journey ahead.

Our approach is rooted in social work ethics and values, meaning we focus on emotional wellbeing throughout the process. We offer ongoing check-ins, counseling referrals, and extra emotional support whenever needed—for both intended parents and surrogates. We know this journey can be exciting but also overwhelming, and we’re here to make sure you never feel alone in it. 

Yes, there are other costs that are not associated with our service fee. Some include;

Independent medical or psychological assessments

Legal services for contracts, parentage, and court filings

Cost incurred by the fertility clinic

Cost associated with hospital fees post birth of baby (eg. NICU admission)

Travel costs for meetings or appointments outside standard agency coverage

Any professional services outside the agency’s scope
